Terms of Service
These Terms govern Image to Layers at imagetolayers.online. By actively accepting these Terms when signing in or purchasing, you agree to them and to the Refund Policy at /refund-policy. The Privacy Policy at /privacy explains how we handle information. Mandatory rights under applicable law are not waived.
1. Service and contact
Image to Layers is operated by Peng Chai in Oregon, United States. Image to Layers accepts supported raster images and uses AI to generate editable visual layers and supported download formats. Results vary and may contain errors, generated details, or incomplete separation. Layer targets are guidance, not a guaranteed output count. Review outputs before important use. For service, billing, privacy, or rights questions, contact support@imagetolayers.online. Image to Layers is not associated with, endorsed by, or affiliated with Adobe Inc. Photoshop and PSD are trademarks of Adobe Inc.
2. Accounts and adult eligibility
You must be at least 18 years old and have reached the legal age of adulthood where you live, whichever is higher. We use verified email magic links and Google sign-in. Both methods require an active adult-eligibility declaration, acceptance of the current Terms, and acknowledgment of the Privacy Policy, recorded with applicable versions and server time. The declaration is not identity verification. Protect your sign-in access and notify us of suspected misuse. We do not offer a guardian-consent exception for minors.
3. Job pricing, reservations, and credits
When enabled, eligible accounts created after the trial launch may use one free Low Resolution + Automatic job across the whole site. This is a non-credit trial: it does not require, grant, reserve, or deduct paid credits. Existing accounts are not automatically enrolled. The trial is subject to shared processing budgets, safety checks, and availability; it may be paused. A successful qualifying delivery consumes the trial. A confirmed failure without a qualifying delivery may restore it for an explicit manual retry, with a 60-second cooldown and at most three attempts in total. Unknown outcomes must be reconciled before retrying; content-policy refusals do not automatically restore the trial. We never automatically retry a trial as a paid job. Paid job pricing below remains unchanged. Low-resolution jobs reserve up to 17 credits and settle at one credit per actual total layer, with a 3-credit minimum. High-resolution jobs reserve up to 34 credits and settle at two credits per actual total layer, with a 5-credit minimum. The background counts as a layer. We show the applicable quote before processing. We release unused reserved credits after settlement. If our server confirms that no qualifying deliverable was provided, we release or return the reserved credits to their original source balances, regardless of whether a provider charged us. A browser closing or a network interruption does not establish that a job failed. A credit return is not an automatic cash refund. Credits are tracked by source. Subscription credits expire at the end of their monthly billing period and do not roll over. Otherwise valid purchased-pack and protected legacy balances are not erased or blocked merely because a subscription is canceled, expires, or has a failed payment.
4. Prices and tax
Prices are in USD. Applicable tax is included in the displayed price and is borne within that price by us; no additional tax is charged to you at checkout. The final total and applicable tax breakdown are shown before payment and in payment records. This does not mean that a transaction is tax-exempt. Purchase eligibility is checked before checkout.
5. Subscriptions, renewal, and cancellation
Standard monthly subscriptions renew monthly: Starter costs $10.99 and issues 34 credits per successful payment; Pro costs $29 and issues 94 credits; Studio costs $69 and issues 259 credits. Our annual options are 12-month commitments paid in 12 monthly installments, not annual upfront payments or month-to-month plans. Starter costs $8 per month, for a $96 initial total commitment; Pro costs $23 per month, for $276; Studio costs $55 per month, for $660. These amounts include applicable tax. Each successful monthly installment issues only that month's 34, 94, or 259 credits. We do not issue a year's credits in advance. A monthly plan renews for another month unless renewal is turned off before renewal. A 12-month plan renews for another 12-month term at the renewal price disclosed before renewal unless renewal is turned off before that date. We provide required renewal and price-change notices. Checkout requires a separate, unselected authorization for recurring charges after disclosure of the price, frequency, term, total commitment, renewal, cancellation, and refund rules. You may turn off renewal through your account or the Customer Portal reached from the billing page. Turning off monthly renewal prevents the next month. Turning off annual renewal prevents the next 12-month term; installments remaining in the current commitment generally continue, except under the Refund Policy or applicable law. Contact support if you cannot access the cancellation controls. We provide a cancellation confirmation. Turning off renewal does not remove valid paid-pack balances. If an installment fails, we notify you and provide at least seven days to update your payment method. Failed installments do not issue credits. We may retry that installment under the disclosed schedule and pause related subscription benefits if it remains unpaid. We do not accelerate all remaining installments, add early-termination penalties, interest, late or collection fees, or send the remaining commitment to third-party collection under these Terms. Other valid paid-pack and protected legacy balances remain unaffected. Multiple missed installments will not be combined into an undisclosed catch-up charge.
6. One-time credit packs
We offer 17 credits for $6.99, 34 credits for $12.99, and 102 credits for $36.99, including applicable tax. Each pack is a one-time purchase: no subscription is required and there is no automatic renewal. You may purchase and use packs without subscribing, and purchase another pack when needed. Purchased credit-pack credits do not expire and are not subject to inactivity, maintenance, or service fees. They may be used only for eligible Image to Layers services and may not be transferred or resold. They are not a general-purpose payment instrument and have no cash-redemption entitlement except under the Refund Policy or applicable law. These statements do not exclude mandatory refunds, low-balance cash redemption, payment disputes, or other legal remedies. A 17-credit balance can cover the maximum reserve for one Low job; High requires up to 34 available credits. Eligible balances may be combined under our credit-allocation rules. Credits do not guarantee a fixed number of images. We may change future offers or job pricing with required advance notice, but will not erase purchased balances, retroactively impose expiry or fees, or retroactively reduce purchased rights. If redemption is permanently discontinued, mandatory remedies for unused paid balances remain available; we will not rely on “no cash value” to avoid obligations required by law.
7. Content rights and acceptable use
You retain your rights in uploaded images and generated files to the extent permitted by law. You grant us a limited, non-exclusive license to host, transmit, process, and reproduce content only as needed to provide, secure, and support the service during the processing and retention periods in the Privacy Policy. We do not take ownership of your content or obtain permission to keep or use source images indefinitely. Commercial use is subject to the rights in your inputs and outputs and any applicable plan conditions. An output does not transfer rights you do not otherwise have, and copyright protection for AI output is not guaranteed. You must have the rights needed for your input and intended output use. Do not submit unlawful or infringing content, child sexual abuse material or sexual exploitation, malware, content violating privacy or publicity rights, or content used for fraud, impersonation, harassment, or abuse. Do not evade access, credit, rate, or security controls or violate sanctions or export laws. We may restrict or terminate use where necessary to address violations, with notice where required. Suspension does not automatically forfeit unrelated lawful paid balances or eliminate mandatory remedies. Public examples demonstrate processing only; they do not imply endorsement by depicted people, brands, photographers, or stock platforms. We do not offer those example source images, separate layers, or editable packs as customer download products. Your own authorized job downloads are a separate service.
8. Availability and retention
The Privacy Policy describes separate availability periods for sources, generated results, and temporary callback archives. Generated results are available for 30 days from successful job recording; download your backup before then. Access deadlines are not guaranteed physical deletion times. Deleting media does not erase necessary non-image billing or compliance records or shorten purchased-pack credit validity.
9. Disclaimers and liability
To the fullest extent permitted by law, the service is provided as-is and without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not guarantee accurate, complete, unique, or suitable output. Some jurisdictions do not permit certain exclusions, and those exclusions do not apply where prohibited. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, goodwill, or business opportunities. Our aggregate liability arising from the service will not exceed the amount you paid us during the 12 months before the event giving rise to the claim. These limits do not exclude liability or remedies that cannot legally be limited, including mandatory refund or redemption rights.
10. Governing law, disputes, and changes
Oregon law governs, without regard to conflict-of-law rules. Disputes not resolved informally will be brought in a state or federal court located in Oregon, except that either party may use an eligible small-claims court. This forum provision applies only to the extent permitted by law. Mandatory consumer protections and forum rights in your place of residence remain unaffected. We may update these Terms prospectively. Material changes will have a new effective date and notice where required. Where renewed acceptance is required, we will request it expressly, not infer it from silence or continued use. Existing transaction rights remain governed by the commitments made for that transaction and applicable law. Questions or rights complaints may be sent to support@imagetolayers.online.
